Can I still apply to have my mothers status changed?

I am an adult green card holder living in the US. My mother who currently resides in the US originally arrived in the country on a tourist visa 10 years ago. She has now overstayed her visa.Can I still apply to have her status changed to legal resident??

You can petition for your mother once you become a US citizen and are over the age of 21. Unfortunately, you cannot petition for her as a Lawful Permanent Resident.

AFTER you become a US citizen, yes, you could sponsor her for a green card. And, if you don't have the wrong kind of criminal convictions, you should naturalize and you should sponsor her. It's just the right thing to do. It's always smart to get a second opinion.

There is no process for a permanent resident to sponsor a parent. As such, you cannot sponsor her now. However, if you obtain your U.S. citizenship, you would then qualify to sponsor your mother to change her status to permanent residence. Only after you become a US citizen, for 2 reasons. First, there is no qualifying petition for the parent of a permanent resident and second, she will need to adjust status requesting a forgiveness of her immigration violations of overstay and unauthorized employment. This is only for immediate relatives, including the parent of a US citizen.

You cannot petition for your mother until you are U.S. citizen. There is no immigrant visa petition available for a green card holder to petition for his or her parent. However, once you become a united States citizen, and assuming there are no other issues or negative factors, you could petition for your mother and she could adjust her status in the U.S.

As a legal permanent resident, you can't petition for your mother. As a US citizen, you can petition for her and adjust her status in the US if she entered legally if she otherwise qualifies.
